NOTICE OF APPLICATION FOR REGISTRATION OF LAND CLAIMED TO HAVE BECOME A TOWN OR VILLAGE GREEN
HOLGATE COMMUNITY GARDEN AND PLAY PARK ALSO KNOWN AS UPPER ST PAUL'S TERRACE PLAY AREA
To every reputed owner, lessee, tenant or occupier of any part of the land described below, and to all others whom it may concern.
Application has been made to the City of York Council West Offices Station Rise York YO1 6GA by Mr David Barrett on behalf of the Friends of Holgate Community Garden under Section 15(1) of the Commons Act 2006 and in accordance with the Commons (Registration of Town or Village Greens) (interim Arrangements) (England) Regulations 2007. The application seeks the inclusion in the Register of Town or Village Greens of the land described below, which it is claimed to have qualified for registration as a town or village green on 13th September 2016 under and by virtue of the actual use of the land by local inhabitants for lawful sports and pastimes as of right for not less than 20 years up to and including that date.
The application which includes a plan of the land proposed for registration, may be inspected at City of York Council offices West Offices Station Rise York YO1 6GA between the hours of 8.30am and 5pm. Copies of the application and plan may be inspected at: - York City Reference Library Museum Street, York YO1 7DS
If the registration authority is satisfied that the land described below has become a town or village green as claimed, it will so register the land, and such registration will be conclusive evidence of the status of the land as at the date of registration.
Any persons wishing to object to the registration of the land as a town or village green should send a statement of the facts on which the objection is based to the address belowsoastoarrivenotlaterthan 6th December2016. Anyrepresentationsthatareto be taken into account by the authority in reaching a decision on the application cannot be treated as confidential and will be copied to the applicant for comment and may be disclosed to other interested parties.
Description of the land claimed to have become a Town or Village Green
Land to the north of St Paul's Terrace and Cleveland Street York (and to the south of the railway.)
