TWO drinkers have been jailed for a city-centre attack in which one of them stamped on the face of an unconscious man.
Shaun Michael Kegg, 22, and Lee Michael Franklin, 28, were so drunk they were staggering around Tanner Row shortly after 1.30am on March 1, the Recorder of York, Judge Stephen Ashurst, told York Crown Court.
Howard Shaw, prosecuting, said Franklin struck the first blow when he hit a bystander after Kegg and a fourth man had squared up to each other.
In the fighting that followed, the fourth man fell unconscious to the ground and Kegg stamped on his face. The two defendants then ran off, but were caught by police and their actions were filmed by CCTV.
“Any person viewing that CCTV would shudder to see the way that you stamped on (the victim),” Judge Ashurst told Kegg.
He jailed Kegg, of Heslington Road, York, for 12 months and Franklin, of Etty Avenue, Tang Hall, for eight months. Both men admitted affray.
Franklin was on a community order imposed for domestic violence and on bail for criminal damage and assault at the time of the affray and had more than 80 previous convictions.
Kegg had one previous conviction. For Kegg, Liam Hassan said his client had drunk more than normal because he had recently had a family bereavement.
“He is just a young man who has been very stupid and consumed too much alcohol,” he said.
Kegg had been horrified when he saw the CCTV film of his actions.
For Franklin, Kevin Blount said his client wished he had not got involved.
His cousin had been involved in the situation in Tanner Row and he had misread what was going on. Since getting his community order, he had been working with the probation service to moderate his behaviour.
