FORMER York City player Clarke Carlisle was charged with drink-driving two days before he was seriously injured in an accident on the A64.
The 35-year-old was struck by a lorry on the road south of York on December 22 and remains in Leeds General Infirmary.
However, two days prior, The Metropolitan Police charged Mr Carlisle with failing to provide a sample.
The former QPR, Burnley and Blackpool player spent Christmas in hospital with head and knee injuries, but his wife, Gemma, tweeted on Monday that she hopes her husband will make a full recovery.
A spokesman for North Yorkshire Police said the lorry driver had not been injured in the incident, but had been offered assistance and support by the force and partner agencies.
