MALTON trainer Brian Ellison and jockey Royston Ffrench have won their 'non-trier' appeals over the running and riding of Everest at Ripon last month.
Ellison's £2,000 fine and French's 14-day suspension were quashed and the Jockey Club also lifted the 40-day ban on the gelding.
The racecourse stewards adjudged Everest had been tenderly handled in finishing sixth of eight in the Toteplacepot Handicap at the Ripon track on June 11.
But the panel, after hearing from Ellison and Ffrench, who were both legally represented, did not share that opinion.
They concluded that Everest became unbalanced down the early part of the straight and changed leg stride and were not convinced Ffrench's ride in the final two furlongs prevented his mount running a true race.
