Many people see January as the time to make a new start vowing to be fitter and healthier than before.
Dark nights and cold weather can make fitness clubs and gymnasiums appear safer and more comfortable places in which to shed those extra pounds.
However, before you sign up and part with your hard earned cash, York Trading Standards offers the following advice:
Shop around
By doing this you may be able to find classes or similarly-equipped gyms at a cheaper price. The law does not dictate how much businesses can charge for services or facilities. As a result there can be big differences in prices for almost identical fitness regimes. Check prices with various establishments before committing yourself to high prices.
Payment methods
Some gyms charge a registration fee and then require a payment each time you use the facilities. The initial fee is usually quite small but the price per visit can be relatively high. This method of payment usually works out cheaper for people who are likely to exercise less frequently. Other gyms may require a monthly payment by cheque or direct debit. This form of payment can be cheaper for those planning to work out several times each week. Be realistic about how often you will go. The law does not entitle you to a refund if you simply decide not to use the gym. You can only have your money back if the business breaches a contractual obligation to you.
Terminating the agreement
Make sure that you read all paperwork before signing. Most gym contracts last for 12 months. In most cases, if you have signed an agreement you are deemed to have read it and agreed to be bound by it. Check the small print - you may only be able to terminate your membership in limited circumstances.
Fitness InstructorS
Fitness Instructors often lead classes such as aerobics, circuits or boxercise, and they may also show new members how to use fitness equipment. The Supply of Goods and Services Act 1982 states that a service must be carried out with reasonable care and skill. In practice this means that individuals visiting a gym or class are entitled to rely on the expertise of the "teaching" staff there. However, if you have a pre-existing health condition this must be disclosed to the fitness instructor before you start your course or class.
