SCARBOROUGH Football Club got some good news when the winding up petition brought by Ian Ockenden was dismissed in the Leeds High Court (Chancery Division) yesterday.

The hearing lasted just 20 minutes and club chairman Darrell Littlewood was delighted with the result.

"I always thought that this action was spurious and now the Courts have thrown the case out.

"It is a great pity that some people insist on trying to cause problems for the club as this case has cost £12,000 in legal fees - which would have gone a long way towards paying the players this month."

It was revealed earlier this week that the players have not been paid in September.

The club is not out of the woods yet though, as it is thought that Dave Cusack is now bringing an action from matters which allegedly occurred before the CVA was agreed.

Cusack was at the club during the period when Anton Johnson was involved.

The club is contesting the action.
