THE MILLIONAIRE owner of Flamingo Land theme park and zoo has had assault charges dropped following a reported bust-up with ticket touts.

Gordon Gibb, 36, faced prosecution over a claim he had assaulted Karl Simcock in the car park last summer.

But yesterday the charge was withdrawn by Scarborough Magistrates after Crown lawyers said they had “no option” but to drop the case.

Prosecution witnesses failed to turn up for the trial and the clerk told Mr Gibb: “We are formally dismissing the case. You are free to go.”

Mr Gibb, of The Lodge, Ebberston, Scarborough, had denied assault. He refused to comment as he left the court with his solicitor, Geoff Ellis, but said he may issue a statement later.

Mr Ellis told the court that an organised gang was moving from theme park to theme park throughout the country, selling “two for one” vouchers which they were not entitled to.

The sales were taking place in Flamingo Land’s own park outside the turnstyles.

The alleged incident was described by the lawyer as “a coming together” as the men were being escorted off.

Mr Gibb was also reportedly threatened and had been upset, Mr Ellis continued.

Given the complainant had not turned up at court there was no reason to continue the prosecution, he argued.

North Yorkshire Police were called to the site near Pickering at 10.30am on Saturday, July 28, following reports of an assault.

Mr Simcock, 31, is believed to be from the Manchester area.

Speaking after a previous court appearance, Mr Gibb had said he looked forward to the opportunity to defend himself against the allegations.
